Written Arguments Submitted in Keystone XL Pipeline Case

The attorneys representing Nebraska landowners have submitted their written arguments in Holt County Court in their case challenging Trans Canada’s Keystone XL Pipeline. Landowner’s Attorney Dave Domina says their legal brief is based on three flaws in state law that TransCanada is relying on to use eminent domain to take the land.

Domina says the third flaw is the process of applying for a crude oil pipeline permit is financed by a revolving credit loan from the state. He says the state constitution prohibits the pledges of state credit for private purposes. Domina says it’s not a common practice for a foreign company to use U.S. eminent domain to advance its projects.

Domina says the trial will be held in Holt County Court in October. He is eager to present the landowners case in court and feels he’s presenting a strong position.
