Senate Environment and Public Works Chairman, Jim Inhofe says internal memos submitted by the Army Corps of Engineers to his panel undermine the Clean Water Rule. Nebraska Farm Bureau National Affairs Coordinator, Jordan Dux says it’s just another example of how the rule needs to be reconsidered.

Senator Inhofe’s letter to the Corps of Engineers says their rule is lacking factual, technical and legal support. Dux says the Farm Bureau is continuing their fight against WOTUS in the courts and in Congress. He expects Congress to take up action against the rule when they return from the August recess.

Inhofe told the Corps that it appears the EPA didn’t provide the draft rule to the Corps of Engineers until April 5th, when it was submitted for interagency review.

The WOTUS rule is set to take effect August 28.
