US Judicial Panel Denies Consolidation of WOTUS Lawsuits

A United States Judicial Panel has denied a motion to consolidate lawsuits against the Environmental Protection Agency’s Waters of the U.S. rule. South Dakota Cattlemen’s Association President Todd Wilkinson who’s also an attorney says that will create more chaos and even more potential court action.

He says without consolidating the cases the debate over the Clean Water Rule will go on longer.

Wilkinson says it will also leave cattle producers and farmers in a state of confusion over the rule and how to comply.

The Judicial Panel turned down a petition for consolidation from the government.
The WOTUS rule is on hold however until all of the court action is settled due to a recent stay granted by a Judge.
