Trans Canada Temporarily Loses Eminent Domain

The York County Nebraska District Court has issued a temporary injunction against Trans Canada which disallows their use of eminent domain in the state for the planned Keystone XL Pipeline. Landowner’s Attorney Dave Domina of Omaha says this decision along with an early injunction put in in Holt County means the case moves forward to the Nebraska Supreme Court. He says it’ll take time for the process to play out.

Domina says the earlier Supreme Court decision said landowners did not having standing in the case. He says Trans Canada now has given up on challenging standing and the case may now proceed.

Domina says he feels he has a strong case especially considering the support his clients received from the first Nebraska Supreme Court hearing.
