Thirteen States File Lawsuit Against EPA on Clean Water Rule

Monday, Western States Attorneys General filed a lawsuit in U.S. District Court in North Dakota against the EPA and the U.S. Army Corps of Engineers over their Clean Water Rule. South Dakota Attorney General Marty Jackley says it’s one of two court actions being sought by Attorneys General nationwide against the agencies. He says the EPA and the Corps are overstepping Congressional authority and seizing rights specifically reserved to the States.

Jackley says the EPA and the Corps of Engineers need to go back and redo their rule. He says that’s why they’re calling to have the rule vacated and the EPA and Corps kept from enforcing the Clean Water Rule.

Jackley says because there are a number of important agricultural issues arising, he’s calling for a new committee to be formed at the National Association of Attorneys General to deal with those going forward.

In their complaint the Attorneys General are contending the new definition of the Waters of the U.S. Rule violates provisions of the Clean Water Act and the National Environmental Policy as well as the U.S. Constitution.
