The U.S. Court of Appeals for the Ninth Circuit has issued a decision vacating the registration of three dicamba herbicides. The three are Extendimax from Bayer, Engenia from BASF and Fexapan from Corteva. Minnesota Dicamba Task Force Chairman Bob Worth says the ruling couldn’t come at worse time for growers who have already planted their soybean crop.
The Court did not vacate the EPA registration of Syngenta’s Tavium but Worth says elimination of use of that may come shortly.
Worth says the Court decision leaves soybean growers with little or no options for effective weed control.
Worth says he’s heard Bayer is intending on appealing the decision. He says even if that happens, it will take a long time to settle the issue. The Ninth Circuit Court ruled that the Environmental Protection Agency violated the Federal Insecticide, Fungicide and Rodenticide Act by approving the registration for all three of those dicamba products.
