Supreme Court to Decide Which Court Will Hear WOTUS Case

The U.S. Supreme Court has granted a petition to an industry coalition led by the National Cattlemen’s Beef Association challenging the Waters of the U.S. rule. NCBA Environmental Counsel Scott Yager says the high court will now decide whether the WOTUS case is heard by the District Court or Appeals Court.

He says having the Supreme Court decide to have the case move forward is a victory for NCBA and the industry coalition challenging WOTUS.

Yager says WOTUS is the type of case that belongs in District Court based on Section 509 B of the Clean Water Act. The provision lays out which cases should go to District Court verses Appeals Court.

Yager says having the Supreme Court decide to move forward on WOTUS shows the Court has a continued interest in private property rights and his group looks forward to making oral arguments in the case.
