South Dakota and 12 other State Attorneys General have filed comments to the U.S. Army Corps of Engineers plan to modify Nationwide Permits to incorporate the Waters of the U.S. rules. South Dakota Attorney General Marty Jackley says they’re reminding the Corps and the EPA that WOTUS has been stayed in court with an injunction and they’re not allowed to move forward on the rule.
He says the whole WOTUS rule is ill conceived and hurts agriculture and all areas of the economy while giving federal agencies extraneous powers.
Jackley says the Corps is continuing to create uncertainty for agriculture and businesses.
Jackley adds that it is both premature and unwise to change the Nationwide Permits to incorporate new regulations that are currently stayed and that may well never be applied.
