Special Session May Be Needed to Enact Online Sales Tax

South Dakota legislators may be called back into a special session later this year to clarify the law needed to collect sales tax from online retailers.
Governor Dennis Daugaard’s Chief of Staff, Tony Venhuizen informed legislative leaders of their concerns this week.
Appearing before the interim Appropriations Committee, Venhuizen says the current law could end up being challenged…..

Venhuizen says they won’t make a recommendation on fixing the law….

Under the law, each twenty million dollars in new money would reduce the half cent sales tax increase by a certain percentage, Venhuizen says that could also be questioned……

The sales tax was raised a half cent to help pay for increased teacher salaries.
The interim committee took no action on the report.
