South Dakota Attorney General Pleased With WOTUS Jurisdictional Ruling

This week the United States Supreme Court ruled that federal district courts not the federal court of appeals have jurisdiction to review the 2015 Waters of the U.S. rule. South Dakota Attorney General Marty Jackley says that’s a positive ruling and a very important one.

He says he and 11 of his fellow Midwest Attorney Generals are working to make sure the Federal District Court in North Dakota becomes the centerpiece of deciding what to do with WOTUS.

Jackley says WOTUS opponents continue to battle the 2015 rule in both the courts and the legislative arenas.

The Environmental Protection Agency of the Trump administration is reworking the WOTUS rule but has not yet finalized the proposal to delay the 2015 WOTUS rule.
