South Dakota Attorney General Marty Jackley has joined 14 other State Attorneys General in filing a friend of the court or Amicus brief in supporting the repeal of the 2017 Organic Livestock and Poultry Practices Act. Jackley says the adopted rule from the USDA under that Act governs animal living conditions and animal care and needs to be thrown out.
He says the Organic Livestock and Poultry Practices Act gives too much regulatory authority to federal agencies.
Jackley says the case will take some time to resolve and he expects more State A-Gs to weigh in.
Jackley says the Act was put out as a rule on the last day of the Obama Administration and was influenced heavily by special interest groups without allowing agricultural producers to weigh in. He says this federal overregulation could push organic farmers out of business and in return drive up the cost of organic foods pricing.
