Attorneys General from 30 states including South Dakota are asking the EPA and the U.S. Army Corps of Engineers to delay the implementation of the Waters of the U.S. rule. South Dakota Attorney General, Marty Jackley says because that rule is set to go into effect August 28, more time is needed for the courts to review the legal challenges.
Jackley says the courts need time to rule on who should have jurisdiction over regulating those waters and how much regulation should be allowed.
Jackley says if the EPA and the Corps don’t allow the delay, then more court action may have to be taken by the Attorneys General in order to protect their states from possible economic devastation.
South Dakota joined 11 other states in filing a lawsuit in federal district court in North Dakota asking the court to vacate the new rule and bar the EPA and the Corps from enforcing the new definition.
