Sierra Club in Iowa Will File Legal Action IUB on Dakota Access Pipeline

The Chairman of the Iowa Chapter of the Sierra Club says his group will file a legal action against the Iowa Utilities Board for their approval of the permit for the Dakota Access Pipeline. Wally Taylor says they have thirty days from the issuing of the permit approval to file such an appeal.

He says there are many eminent domain concerns with the project and Iowa law clearly limits use of eminent domain on agricultural land.

Taylor says both the Iowa Utilities Board and State Department of Natural Resources have approved Dakota Access. However, the Army Corps of Engineers has yet to sign off on the project and that could take some time.

Taylor says Dakota Access is scheduled to cross 18 counties in Iowa but they’ll likely file the lawsuit in Des Moines in Polk County where the Iowa Utilities Board is located.
