SDCA President Not Surprised WOTUS Proponents Given More Time In Court

The Sixth Circuit Court of Appeals has given the Environmental Protection Agency and U.S. Army Corps of Engineers an extra month to file their defense of the Waters of the U.S. Rule or WOTUS. South Dakota Cattlemen’s Association President Todd Wilkinson is not surprised by the court’s decision but sees some irony in the situation.

The court also set a deadline of February 19 of 2017 for intervenors to file briefs either in support or in opposition to the rule. Wilkinson sees several organizations trying to have their say on WOTUS.

He says the EPA is motivated by politics in pushing WOTUS and attempting to take control over private land.

The new deadline for the EPA and the Corps to file their briefs is January 18 of 2017.
