South Dakota Attorney General Marty Jackley has asked the state Supreme Court to rule against the state in a lawsuit over online retailers not paying state sales taxes, in effect, moving the case to the US Supreme Court…..
Jackley told Justices Tuesday that the retail landscape is changing…..
George Isaacson, a lawyer from Maine representing the defendants, questioned the law at the basis for the lawsuit….
The law would force out of state internet companies to pay state sales taxes.
Isaacson says that change could hurt businesses in the state too…..https://soundcloud.com/wnax-radio/george-isaacson-830b
South Dakota has estimated it is missing about fifty million dollars a year in those sales taxes.
The Justices listened to about forty-five minutes of arguments, and will issue an opinion later.
