SD Supreme Court Hears Amendment “A” Arguments

The South Dakota Supreme Court heard arguments Wednesday over the constitutionality of “Amendment A” that legalized recreational marijuana and was approved by voters last November.
Brendan Johnson, lawyer for the supporters, pointed to the foundation of the state and the writing of the state constitution as the backing for their amendment..

Johnson says it will be difficult for the Court to ignore those who voted for the amendment…

Lisa Prostrollo, representing Highway Patrol Superintendent Rick Miller, one of the plaintiffs said the case is not about marijuana…

Prostello told the court that the amendment does not stick to the single subject rule….

The Justices asked both attorneys a number of questions about their arguments, then wrapped up the one-hour session. A ruling will be issued at a later date.
