South Dakota legislators will be back in Pierre on Monday for a special session to deal with non-meandered lakes. The issue was set because the state Supreme Court ruled that neither the state nor landowners had superior rights over those flooded areas.
Senator Reynold Nesiba of Sioux Falls says he hasn’t decided on the bill yet…

Nesiba, a democrat, is concerned about what the state loses in the bill….

Republican Senator Art Rusch of Vermillion says he is hearing lots of opposition to the bill…..

There has been some discussion of giving flooded landowners a break on their property taxes. Rusch says that would cause other problems…..

The bill will require a two thirds majority vote to be enacted right away under the emergency clause.
