Monday the U.S. Supreme Court announced it will not take up Growth Energy’s appeal of the D.C. Circuit Court decision that struck down EPA’s year-round E15 rule. Iowa Renewable Fuels Association (IRFA) Executive Director Monte Shaw says it was disappointing the court decided not to extend the seasonal RVP on E15, and they think the court got it wrong.
He says the decision underlines the need for states to act to ensure E15 can be sold all year and it is the only option to get the change done in time for the summer driving season. In fact, late last year eight Midwestern governors, led by Iowa’s Kim Reynolds, wrote to EPA asking for state waivers.
Shaw says longer term they’ll continue to press EPA because the Clean Air Act provides the agency ample authority to expand E15 nationwide and year-round.
Several farm state lawmakers also introduced a legislative fix to allow summer sales of E15 but the bill expired before it could be voted on.
