RFS Lawsuit Launched Against EPA by Biofuels Industry

Biofuels producers are initiating a legal challenge against the EPA’s use of its waiver authority to lower renewable volume obligations under the Renewable Fuel Standard.  The National Corn Growers Association is part of the coalition initiating the lawsuit in the U.S. Appeals Court for the D.C. Circuit and President Chip Bowling says they believe they have a good case.

South Dakota Senator John Thune says the lawsuit doesn’t surprise him.   He thinks the renewable fuels industry has good legal standing because EPA didn’t follow the Congressional intent of the RFS.

He says it’s time for the Administration to live up to the promises contained in the RFS and move past the blend wall to increase consumer demand.

Meanwhile, American Fuel & Petrochemical Manufacturers President Chet Thompson says they fully support EPA’s decision and they are confident that the D.C. Circuit will uphold EPA’s legal authority to grant a waiver. He says it’s time for Congress to repeal this broken program and for the biofuels industry to stand or fall on its own, without government subsidies.
