RFA President Says ABFA Court Dismissal Won’t Hurt RFA’s Litigation

This week a federal court dismissed one of several lawsuits challenging the Environmental Protection Agency’s granting of small refinery waivers. The U.S. District Court of Appeals ruled the Advanced Biofuels Association didn’t identify a final agency action in its lawsuit. Renewable Fuels Association President and CEO Geoff Cooper says that court ruling won’t hurt their court case challenging the EPA on the SREs.

He says even though the court dismissed ABFA’s suit, it was sympathetic to the biofuels industry and that the EPA mismanaged the SRE program.

Cooper says the small refiner exemptions have caused severe economic damage to the renewable fuels industry and that his group along with the other 5 ag groups challenging the EPA will continue their fight in the courts.

Cooper says it’s critical people submit their comments to the EPA on their supplemental RFS proposed rule. He says the deadline to comment is November 29.
