RFA Disappointed President May Join In SRE Appeal

Those who may appeal the 10th Circuit Court decision on the small refiner exemptions now have until March 24 to decide whether or not they’ll proceed with that. The original deadline had been March 9, however a Judge ruled Monday morning the U.S. Justice Department has 15 more days to make their decision. Renewable Fuels Association President Geoff Cooper is concerned with the delay and is also concerned that President Trump is considering joining that appeal.

He says not only is the biofuels industry in favor of the original Circuit Court ruling but so is the Petroleum Industry, save for two refiners.

Cooper says even if the 10th Circuit Court decision is appealed, he’s confident the original decision will be upheld.

The 10th. Circuit Court ruling January 24 said the EPA did not have the authority to issue small refiner exemptions to three companies not originally granted the waiver.
