A Wyoming rancher is asking a federal court for injunctive relief after the EPA fined him for putting a stock pond on his property. The agency says Andrew Johnson violated the Clean Water Act. However, the Act does not define stock ponds or dams. National Cattlemen’s Beef Association Vice President of Government Affairs Colin Woodall says this is exactly what’s wrong with the Clean Water Act and the Waters of the U.S. rule.
Woodall also says now that WOTUS is allowed in 37 of the 50 states it adds more uncertainty for producers. He says the North Dakota District Judge that granted the injunction for the 13 states on WOTUS did not stretch that out to the other courts.
Woodall says NCBA will continue to fight WOTUS in Congress. However, stopping the rule in the courts is the only way to protect producers from activist lawsuits.
Woodall says with a temporary injunction in 13 states EPA doesn’t have a consistent WOTUS rule in place and is only able to implement a part of the rule.
