R-CALF has filed a legal brief challenging a rule put in by the USDA requiring that livestock producers use only radio frequency identification ear tags on all adult cattle moving interstate beginning January of 2023. R-Calf CEO Bill Bullard says a private committee aided USDA in developing the RFID rule which they’re claiming is illegal.

He says they’re litigation is calling for the court to issue an injunction preventing the USDA from using any of the committee’s recommendations.

Bullard says the status of the USDA RFID rule is unknown at this time because the Biden Administration has frozen all pending regulations.

Bullard says the USDA has 30 days to respond to their brief, then following their response, R-CALF has 14 days to reply and following that it would head to a court hearing.
