R CALF Appealing District Court’s Decision On The Beef Checkoff

R CALF officials say they will appeal the Montana District Court’s decision that threw out their challenge of the beef checkoff. R CALF CEO Bill Bullard says the important issue has to do with whether a constitutional violation can be fixed with what’s known as a revocable contract.

He says states were given authority to put in memorandums of understanding which converted private speech to government speech which is not proper.

Bullard says they’re also arguing it’s not proper for the NCBA to purchase board seats on the state beef councils in order to control checkoff monies when the money is supposed to be used for goods and services.

The appeal is being filed with the 9th. Circuit Court of Appeals in California.
