OCM Official Says It’s Positive Justice Department Investigating DFA Dean Foods Merger

The U.S. Justice Department is investigating Dairy Farmers of America’s purchase of the bulk of Dean Food’s operations for $425 million. The deal is contingent on the approval from the Justice Department as well as a federal bankruptcy court. Organization for Competitive Markets Policy and Research Director Ben Gotschall says it’s positive that DOJ is looking into the matter and they support that.

He says one of their main concerns is having monopoly’s taking place in several regions.

Gotschall says another concern is that DFA has had a history of antitrust problems.

Gotschall says OCM will continue monitoring DOJ’s investigation as well as submitting comments to the Federal Trade Commission’s rule making on vertical mergers.
