NRDC Files WOTUS Lawsuit

The Natural Resources Defense Council has filed a lawsuit in Federal District Court in Washington, D.C. against the Environmental Protection Agency, Army Corps of Engineers and U.S. Justice Department. NRDC Deputy Director for Water Policy Becky Hammer says the litigation was filed over the federal government’s failure to provide records regarding the rewrite of the Waters of the U.S. Rule.

She says NRDC had made a Freedom of Information Act request on the new proposed WOTUS rule and didn’t receive a response.

Hammer says NRDC had supported the 2015 Obama era WOTUS rule and they don’t think the Trump administration has shown that that regulation was flawed and needed to be rewritten.

Hammer says the public deserves all the information regarding the new WOTUS proposal and especially needs it as the public comment period is set to begin shortly.
