The Natural Resources Defense Council is defending the Waters of the U.S. Rule after attempts to kill the measure this week. On Tuesday the Senate failed to get 60 votes for cloture on a bill that would throw out the EPA rule. However, Senators did pass a resolution of disapproval to withdraw WOTUS. NRDC Senior Attorney Jon Devine is hopeful the Clean Water Rule will eventually be implemented.
Devine says the Clean Water Rule has been mischaracterized and provides needed water quality protections.
And he says the EPA’s rule is not an overreach of its powers.
Devine says the court action on WOTUS is only in the preliminary stages. However, he’s confident when the court finally rules on the substance of the Clean Water Rule it will be upheld.
