The National Pork Producers Council has joined the EPA in asking for a delay on emission reporting requirements for livestock operations under CERCLA. Earlier the District of Columbia Court ruled that an EPA exemption for ag operations is no longer allowed. NPPC Assistant Vice President for Domestic Affairs and Counsel Michael Formica says they want a delay on air emissions reporting to January 17 of 2018.
He says time is needed to fix the reporting requirement because that information from 63,000 farms may now go to anti ag activists.
Formica says the CERCLA or Comprehensive Environmental Response Compensation and Liability Act rule is a difficult one for producers to figure out what needs to be reported for them to be in compliance.
Formica says enforcing the CERCLA reporting requirements on producers before the EPA can provide them with guidance will trigger confusion among farmers and agencies without benefitting the public.
