A Federal Appeals Court has yet to decide whether reporting of livestock emissions is needed under the CERCLA (Comprehensive Environmental Response, Compensation and Liablity Act) or Superfund law. The Environmental Protection Agency has said it won’t enforce the reporting requirement until the court rules on their request for a delay on the implementation. Michael Formica, Assistant Vice President of Domestic Affairs and Counsel for the National Pork Producers Council says their joining EPA in their request for a delay.
He says the only way for producers to know the amount they’re emitting is to have monitors on their operations.
Formica says NPPC is talking to lawmakers about possible legislation to change or possibly get rid of this emissions reporting regulation.
Last November the Federal Court of Appeals delayed the reporting rule until January 22 but now another possible delay is being considered.
