The National Pork Producers Council this week filed comments in California on the proposed rules for the state’s Proposition 12 law passed by voters over two year ago. Those rules aren’t even close to being finalized so producers know how they must comply with their animal housing rules. NPPC’s Assistant Vice President and General Counsel Michael Formica says they want California to delay compliance dates with Prop 12 which is set to be implemented January 1, 2022.
He says California officials want to inspect all trucks hauling pork and believes Prop 12 gives them the right to do that on all trucks whether from in state or out of state.
Formica says the pork isn’t illegal until it’s sold under Prop 12. He also says there are problems with the inspections California is proposing with their Prop 12 rules.
Formica says besides commenting on this rule, NPPC is continuing their Court battle against Proposition 12. He says it violates the Commerce Clause of the U.S. Constitution and forces it’s rules on other states.
