Around 30 Nebraska landowners have won a court victory in Holt County against Trans Canada. BOLD Nebraska Energy Director Ben Gotschall says on Thursday, the Nebraska District Court in Holt County placed an injunction on Trans Canada’s eminent domain takings of land along the route of the proposed Keystone XL pipeline.
The injunction means those landowners property will be temporarily protected from being seized by a foreign company. The injunction is in place until the State Supreme Court hears the landowners case on the constitutionality of LB 1161, the siting law that gave Trans Canada the power to use eminent domain to build the pipeline. Gotschall says any other landowner who wants to be added to this case should contact Domina law firm.
Another case where landowners are seeking an injunction is going through the court system in York County. No decision has yet been made on that request.
