A pair of new lawsuits have been filed in Nebraska by opponents of the Keystone XL Pipeline project. Omaha Attorney Dave Domina represents the two landowners, one from Holt County, the other from York County. He says the action is being brought against Trans Canada in order to stop them from using eminent domain power to gain access to their land.
The lawsuits are looking to overturn a state law that allowed Former Governor Dave Heineman to approve the pipeline’s route. Domina says there are many problems brought with the easements being sought by Trans Canada.
In the recent Keystone case involving the Nebraska Supreme Court, justices ruled that landowners lacked standing. Domina says standing isn’t an issue in this case because the action is directed against Trans Canada which has already given notice it’s condemning the landowner’s property.
