Nebraska Landowners Randy Thompson, Susan Dunavan and Susan Luebbe have won their court case against Governor Dave Heineman, the State Department of Environmental Quality and the Attorney General. The Lancaster County District Court found LB 1161 passed by the Unicameral in 2012 as unconstitutional. It had given the Governor authority to approve a crude oil pipeline and allow that company the right to exercise eminent domain. Randy Thompson of Martell says the court had no choice but to rule the way they did.
Thompson says Trans Canada is back to square one with their Keystone XL project.
Thompson says the power of granting eminent domain is now where it should be with the Public Service Commission and not in one man’s hands.
The Governor, DEQ and Attorney General have thirty days to decide whether or not to appeal the District Court’s ruling.
