Nebraska Cattle Group Wants Brand Act Declared Unconstitutional

A group of Nebraska feedlot operators are asking a federal judge to declare the Nebraska Livestock Brand Act unconstitutional and prevent the state from enforcing it. A civil complaint was filed last week in U.S. District Court. Nebraska Cattlemen Association Executive Director Pete McClymont says his group is monitoring the development.

He says his group supports the work being done by the Nebraska Brand Committee.

McClymont says while they’re monitoring the litigation, they did intervene earlier when the state legislature attempted to raid Brand Committee funds. They were successful in getting those restored.

Lincoln attorney Katherine Spohn is representing the Nebraska Beef Producers Committee, the group bringing the lawsuit. The civil complaint has been filed against the Nebraska Brand Committee and Executive Director Bill Bunce.
