NE Landowners Challenge Eminent Domain Law

A Nebraska court judge took under advisements arguments presented in the case of Nebraska landowners against Trans Canada’s Keystone XL Pipeline route. Trans Canada has dropped their eminent domain proceedings and are seeking approval for the pipeline route through the State Public Service Commission. Landowner’s Attorney Brian Jorde says while Trans Canada is claiming the lawsuit is moot, his clients are still challenging the state law that gave the Governor sole authority on pipeline siting and authorization.

Jorde says the case will eventually end up before the Nebraska Supreme Court.

He says there is also a question whether the State Public Service Commission has authority over Trans Canada’s XL Pipeline permit application.

Jorde expects a decision from the Holt and York courts by mid-December. Following that an appeal could be made by either side.
