There are more questions than answers as to what might happen to the Navigable Waters Protection Law approved by the Trump Administration. That replaced the 2015 Obama era Waters of the U.S. Rule. National Cattlemen’s Beef Association’s Chief Environmental Counsel Scott Yager says the writer of the Obama WOTUS rule is on President elect Biden’s transition team., but it isn’t clear if that might come back and replace the Navigable Waters Protection regulation.

He expects the Biden administration and his EPA Administrator Nominee Michael Regan to take a different approach to waters protection than did the Trump administration.

Yager says NCBA will continue to protect cattle producers rights that are included in the Navigable Waters Protection rule and will weigh in with the Biden administration on that.

Agriculture groups including NCBA in 2015 fought against the WOTUS rule saying it was an overreach of federal authority.
