National Cattlemen’s Beef Association officials say their court case challenging the Waters of the U.S. rule is still under consideration. That despite this week’s Executive Order directing the EPA to either rewrite or rescind the rule. NCBA Vice President of Government Affairs Colin Woodall says the Supreme Court has delayed any movement on the court side of the issue until this fall.
He says the Supreme Court anticipated the President’s Executive order and called for the delay in the court action until the EPA has time to either rewrite or rescind WOTUS.
Woodall says WOTUS won’t go away immediately as it’ll take time for the EPA to take action and there will have to be a rulemaking process.
Woodall says while his group prefers that the rule be thrown out entirely, having it rewritten could be to their advantage.
