National Cattlemen’s Beef Association officials are hailing the Environmental Protection Agency’s rewrite of the Waters of the U.S. rule. NCBA Environmental Counsel Scott Yager says the EPA proposal will end up in court as environmental groups will challenge it. He says they even challenged the 2015 version of WOTUS.
He says their argument in court will center around the Administrative Procedures Act which is the law that governs the process by which federal agencies develop and issue regulations.
Yager says the litigation will likely reach the U.S. Supreme Court where NCBA and agriculture groups will prevail.
Yager says the EPA WOTUS rewrite is a much better rule than the 2015 version of WOTUS. He says it exempts (ee-fem-uh-rull) ephemeral and most farm ditches and stock ponds from being regulated.
