The National Cattlemen’s Beef Association, National Pork Producers Council and American Farm Bureau Federation have all filed court briefs opposing the Waters of the U.S. rule. The rule brought forward by the Environmental Protection Agency and Army Corps of Engineers is being challenged in the Sixth Circuit. NCBA President Tracy Brunner says he’s confident in the strength of their argument against the proposed rule.

He says WOTUS lacks clarity and the government agencies have been inviting a court challenge to their regulation.

Brunner says there’s no doubt the EPA and Corps are exceeding their authority by pushing this rule.

Proponents of the rule have extra time to file their briefs and have until January of 2017 to get that done.
