The American Fuel and Petrochemical Association is asking the U.S. Court of Appeals for the District of Colombia not to remand the lost biofuel gallons caused by the allowance of a large number of small refinery waivers. The Biofuels Coalition which includes the National Biodiesel Board is standing by their request to have those volumes restored. NBB CEO Donnell Rehagen says the Renewable Fuel Standard needs to be upheld and getting those volumes restored is critical in that.

The AFPA’s motion argues that the court’s original ruling does not mandate a particular outcome by the EPA for remand. Rehagen disagrees and says the court’s decision in 2017 that was upheld is clear.

He says NBB intends to work with the new EPA and Biden administration on this issue as well as fighting for resolution in the courts.

The AFPA claims the biofuels charge of harm in their lawsuit is speculative.
