NBB Asks EPA For Transparency On Any GAP SRE Petitions

The National Biodiesel Board has written to the EPA administrator asking that he disclose any small refiner exemption petitions for RFS compliance years before 2019. NBB’s Paul Winters says the issue came up when EPA Administrator Andrew Wheeler appeared before two Senate Committees.

He says refinery exemptions from the RFS have been growing and expanding and have caused damage to the biofuels industry.

Winters says there has not only been a loss of biodiesel itself but several plants have either cut back or shutdown completely.

Winters says the 10th Circuit Court made it clear which exemptions are allowed and which are not. He also says the GAP SREs go against the 10th Circuit Court ruling.

Winters says allowing GAP filings would render the RFS entirely unpredictable for renewable fuel producers.
