Lawsuit to Stop Dakota Access Pipeline Proceeds

A Des Moines law firm has filed a lawsuit against the Iowa Utilities Board for their approval of a permit for the Dakota Access Pipeline. The law firm represents the Northwest Iowa Landowner’s Association. Association Attorney John Murray says what they’re arguing goes back to a case tried in Cherokee County last year that claimed Dakota Access is not a utility.

He says the Cherokee County Judge failed to rule on their question and so they took it one step further, which led to this filing in Des Moines in Polk County Court.

Murray does not expect a quick resolution to their court challenge.

Murray says besides their concerns with the lawsuit, landowners also have worries about eminent domain being used by Dakota Access and possible detrimental environmental impacts.
