Landowners In 5 States Suing Corps For Flood Damage

A group of farmers and businesspeople from five states have filed a federal lawsuit against the U.S. Army Corps of Engineers.  Polsinelli law firm of Missouri is representing the group. Their Attorney Seth Wright says the case will be heard in the U.S. Court of Federal Claims in Washington D.C. He says that’s a special court set up to hear litigation involving the federal government.

Wright says their case is based on the fifth amendment of the U.S. constitution and that the Corp’s actions that de emphasized flood control in favor of wildlife resulted in a takings.

Wright says the flooding caused a large amount of farmland to be devastated by flooding that happened several times.

Farmers and Business people represented in the case have land in South Dakota, Nebraska, Iowa, Missouri, and Kansas.
