Friday, Omaha attorney Dave Domina representing three Nebraska landowners argued before the Nebraska Supreme Court challenging the constitutionality of LB 1161. That law gave the Governor authority to grant a route for the Keystone XL Pipeline through Nebraska. A lower court earlier ruled in favor of the landowners throwing out that law. Domina says routes for all common carriers belong in the hands of the Nebraska Public Service Commission.
He says if the Supreme Court rules in favor of the lower court there are three things that could occur including Trans Canada going back to square one with their project.
Domina never likes to predict how judges might rule but did say based on the questions he heard from the Justices he feels good about his case.
Domina doesn’t expect the Nebraska Supreme Court to rule before the November Election.
