Judges Decision Opening to Challenge Dakota Access Pipeline

A decision last week by a federal judge to call for an environmental analysis of the Dakota Access Oil pipeline has implications for other states where the pipeline is located. Earlier the pipeline received approval and had already started shipping oil. One of the states impacted is Iowa. Bold Iowa Executive Director Ed Fallon, whose group opposes the pipeline, says the judge’s decision gives them an opening for a new challenge to the project.

He says even though the Iowa Utilities Board approved the pipeline project earlier, they could stop the project on this latest filing.

Fallon says there are several problems with the Dakota Access pipeline and some farmers are already being impacted by it.

Fallon adds some Iowa landowners are continuing their lawsuit against Dakota Access over eminent domain issues. Their attorney is arguing that eminent domain shouldn’t be given to a private company if it’s not providing a public service. That’s expected to be heard in the State Supreme Court this fall.
