IRFA Executive Expects Oil Companies To Appeal Circuit Court’s SRE Decision

Oil company representatives have been on Capital Hill working with Senators Ted Cruz and Jim Inhofe pushing back against the Trump Administration’s EPA wanting them not to curtail giving out small refiner waivers despite a court ruling. Iowa Renewable Fuels Association Executive Director Monte Shaw expects them to ask the 10TH Circuit Court for a re-hearing on the waiver issue.

He says the oil industry wants the Court to reconsider the issue and allow the EPA to continue granting SRES. Shaw says those small refiner exemptions never should have been allowed in the first place.

Shaw says the oil companies don’t care about the RFS or following the law, they just don’t want the competition from biofuels.

Oil industry officials believe that if the original 10th Circuit Court decision holds up, it’ll place limits on the EPA’s ability to hand out large numbers of RFS waivers. They’re hoping President Trump will intervene and order a more favorable decision for their industry.
