A North Dakota Federal Judge says Iowa can temporarily stop enforcing the 2015 Waters of the U.S. rule. The rule is now on hold in 28 states. An earlier ruling by a South Carolina court had reinstated the rule where it hadn’t already been enjoined by a lawsuit. Iowa can postpone enforcing WOTUS 2015 until the court proceedings are complete. Iowa Pork Producers Association CEO Pat McGonegle says the North Dakota ruling is a win for Iowa’s pork producers.
He says had the 2015 WOTUS rule been implemented in Iowa it would have created several problems.
McGonegle says his group is looking forward to the rewrite of WOTUS at the federal level and the North Dakota Court decision gives Iowa’s pork producers protection during that process.
While ag and business groups oppose the 2015 WOTUS rule, it’s supported by many environmental groups.
