Iowa Attorney Files Appeal In Pipeline Lawsuit

Court action involving the Bakken Pipeline eminent domain proceedings is being appealed. Des Moines Attorney Bill Hanigan who represents Northwest Iowa landowners says a Cherokee Iowa Judge decided against his filing of a stay in the case so now he’s appealing that action.

He says eminent domain proceedings are likely to happen on the land not being appealed by the end of this month.

Hanigan says all of the administrative appeals on the pipeline in Polk County court will likely be combined.

Energy Transfer Partners of Texas, builders of the Dakota Access Pipeline have received approval from the Iowa Utilities Board to go ahead with construction in the part of Iowa not regulated by the U.S. Army Corps of Engineers. The Corps has yet to rule on the project.
