HSUS Lauds Judge’s Decision On California Egg Law

Last week a Federal Judge threw out a lawsuit filed by Five states including Iowa asking the court to strike down California’s law on hen housing. HSUS Ag Director Joe Maxwell says the Judge made the right decision in protecting hens from cramped living conditions.
The federal judge in making the ruling notes that the state’s lacked legal standing to sue because they failed to show the California law does genuine harm to their citizens instead of just possible future damage to some egg producers. Maxwell says other states will benefit from the judge’s decision. q. have a right to protect
The state’s that filed the suit contended the California law violates the interstate commerce clause of the U.S. Constitution by effectively imposing new requirement on out of state farmers.
