The South Dakota House Education Committee voted to repeal the foundation funding legislation. The original law was put into place in 1995 when the education funding formula was revised.
Education Department Secretary Melody Schopp told the lawmakers that the law deals with accreditation standards.
Schopp says the law assures standards are the same from district to district.
Representative Peggy Gibson of Huron said that even without the law, the legislature would still have rule making authority over education standards.
The bill passed out of committee on an eleven to four vote and now heads to the House floor.
